Memorandum of Understanding on Economic and 

Technical Cooperation Between 
the Government of the Kingdom of Cambodia 
and the Government of the Republic of India
 

                  

The Government of the Kingdom of Cambodia and the Government of the Republic of India hereinafter referred to as the Contracting Parties.

 

Recognizing the friendly ties existing between the people of the two countries;

Considering that their people have a common interest in economic progress and that their joint efforts to share technical knowledge and skills will assist in achieving this objective;  

 

Desirous of advancing the closest possible cooperation in the economic and technical fields on the basis of equality and mutual benefit;  

 

Noting that such cooperation between the peoples of the two countries will advance further the cooperative effort;  

 

Have agreed as follows:

Article 1:         

The Contracting Parties shall facilitate and promote economic and technical cooperation between the two countries in conformity with the provisions of this Memorandum of Understanding.  

 

Article 2:         

The Contracting Parties shall cooperate to implement this Memorandum of Understanding through the public and private sectors.  

 

Article 3:         

The Contracting Parties shall accord to each other the Most Favoured Nation treatment with regard to their economic and technical relations without prejudice to the special terms and concessions enjoyed by each Contracting party in the context of its special arrangement with other countries.  

 

Article 4:         

The Cooperation envisaged under Article shall extend to the following:  

(1) Training of the Cambodian nationals in designated, Indian Institutions. The number of trainees and the Institutions/courses where they would be imparted training shall be determined by both the Contracting Parties on an annual basis. The terms and conditions of the Indian Technical and Economic Cooperation (ITEC) shall be applicable to such training facilities unless otherwise agreed to between the Parties.

(2) Deputation of Indian experts to Cambodia in mutually agreed fields.

(3) Conducting of feasibility studies and setting up of pilot project in Cambodia by Indian experts.

(4) Extension of consultancy services by Indian experts.

(5) Setting up of joint projects.

(6) Any other means of cooperation, as may be agreed between the parties.  

Article 5:         

The persons deputed under this Memorandum of Understanding shall comply with the laws and regulations in force in the host country.

 

Each Contracting Party shall extend to experts and/or trainees of the other Contracting Party present in its territory under a cooperation programmes envisaged under this Memorandum of Understanding, all such facilities as permissible under its laws and regulations, as may be necessary for the successful fulfillment of the duties.

 

Article 6:         

The Project/Studies/Training Programmes envisaged under this Memorandum of Understanding shall be established in each case by exchange of letters between the Contracting Parties or on the basis of contracts to be signed between the concerned commercial enterprises and the State Organizations in the private and public sector of the two countries respectively.  

 

Article 7:         

This Memorandum of Understanding shall enter into force on the date of its signing and shall remain valid for a period of five years and may be renewed for subsequent period at a time unless either of the parties gives to the other a written notice six months in advance, of its intention to terminate the Memorandum of Understanding from the date of its expiry.  

 

This MOU may be amended or modified by mutual Consultation of the Parties.

 

Any disputes arising from the interpretation or implementation of this MOU shall be resolved by mutual consultations of the parties.  

 

The termination of the Memorandum of Understanding shall not affect the validity of contracts/Projects already in progress.  

 

In witness whereof, the undersigned being duly authorized by their respective government, have signed this Memorandum of Understanding.  

 

Done at Phnom Penh on this eighteenth day of January, 1996, in two originals each in Hindi, Khmer and English languages, all the texts being equally authentic. In case of doubt, the English text shall prevail.
