THE ESTABLISHMENT OF JOINT INTER-MINISTERIAL COMMITTEE

FOR THE PREVENTION OF ILLEGAL FISHERIES INFRACTIONS

ON CAMBODIAN TERRITORIAL SEAS

  •  Referring to the Constitution of the Kingdom of Cambodia;

  • Referring to Reach Kret No. NS/RKT/1198/72 of November 30, 1998 on the Formation of the Royal Government of Cambodia;

  • Referring to Reach Kram No. 02/NS/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

  • Referring to Prakas No. 02/PRK of the Royal Government of May 10, 1999 on the Rules for Managing and Eliminating Illegal Fishing;

  • Pursuant to the needs of the Royal Government.

IT IS HEREBY DECIDED 

Article 1:    To establish a Joint Inter-ministerial Committee for the Prevention of Illegal Fisheries Infractions in the Territorial Seas with the following composition:

-  H.E. Chay Sain Yun and H.E. Por Bun Sroeu, Co-Secretaries of State,Ministry   
   of National Defense

-  H.E. Prum Sokha, Secretary of State for Interior Member
-  H.E. Mey Sam Oeun, Secretary of State for Agriculture, Forestry and Fisheries Member
-  H.E. Chhann Saphann, Secretary of State for Environment Member
-  H.E. Suy Nou, Secretary of State for Justice Member
-  H.E. Hok Lundy, Director General of the National Police, Ministry of Interior Member
-  H.E. Meas Sophea, Chief of General Staff, Cambodian Royal Armed Forces Member
-  H.E. Sao Sokha, Commander of National Military Police Member
-  H.E. Sean Visoth, Permanent member of the Anti-corruption Unit Member
-  H.E. Provincial Governor of Koh Kong Member
-  H.E. Provincial Governor of Kampot Member
-  H.E. Governor of Sihanoukville Member
-  Director of Department of Fisheries Member
-  Mr. Chhay Savuth, Representative of the Anti-corruption Unit Secretary

Article 2: The Joint Inter-ministerial Committee shall have the following roles and missions:

  • To conduct further research over all forms of illegal offense associated with fisheries that are currently occurring in Cambodian territorial seas;

  • To take immediate measures to prevent illegal activities associated with illegal fishing, prevent illegal groups from threatening and extorting money from fishing boats, and restore order on the territorial seas;

  • To request the Royal Government to temporarily suspend civil servants, military or police officials involved in the commission of illegal fishing, and propose temporary new replacement appointments to ensure work continuity; and

  • To prepare a detailed report of inspection and submit to the Royal Government.

Article 3:    The Joint Inter-ministerial Committee shall have one working group to perform continuous activities in each maritime province and municipality. 

Article 4:    The Minister in charge of the Office of the Council of Ministers, the Minister of Parliamentary Relations and Inspection, the Minister of Agriculture, Forestry and Fisheries, relevant ministers and secretaries of state and interested individuals stated in Article 1 shall effectively implement this Decision from the date of signature.
