PRAKAS  
on the Allocation of Surrendered Quotas for Export of Textile Products
to the United States of America before the end of Financial Year 1999

  • Referring to the 1993 Constitution of the Kingdom of Cambodia; 

  • Referring to Kram 02/NS/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

  • Referring to Reach Kret NS/RKT/1198/72 of November 30, 1998 on the formation of the Royal Government of Cambodia;

  • Referring to Kram No. NS/RKM/0196/16 of January 24, 1996 promulgating the Law on the Establishment of Ministry of Commerce; 

  • Pursuant to the Agreement Relating to Trade in Cotton, Wool, Man-made fiber, Non-cotton Vegetable Fiber and Silk Blend Textiles and Textile Products between the Royal Government of Cambodia and the Government of Cambodia and the Government of the United States of America of January 20, 1999; 

  • Referring to the Council of Ministers' meeting of January 29, 1999; 

  • Referring to Prakas No. 360/MOC/M99 of February 1, 1999 of the Ministry of Commerce on the establishment of the Export Quotas Management Committee for textiles and textile products subject to limitations by the United States of America;

  • Referring to Prakas No. 581/MOC/M99 of February 25, 1999 of the Ministry of Commerce on the Result of tender for Quota on Garments to be exported to the United States of America; 

  • Referring to Prakas No. 665/MOC/M99 of March 5, 1999 of the Ministry of Commerce on the Tender for Quota on Garments to be exported to the United States of America;

  • Referring to Prakas No. 666/MOC/M99 of March 5, 1999 of the Ministry of Commerce on Certain Amendments to the Ministry of Commerce’s Prakas No. 360 MOC/M99 of February 1, 1999 on the establishment of' the Export Quotas Management Committee for textiles and textile products subject to limitations by the United States of America;

  • Referring to Prakas No. 748/MOC/M99 of March 15, 1999 of the Ministry of Commerce on Certain Amendments to the Ministry of Commerce’s Prakas No. 665 MOC/M99 of March 5, 1999 on the tender for Quota on Garments to be exported to the United States of America; 

  • Referring to Prakas No. 793/MOC/M99 of March 19, 1999 of the Ministry of Commerce on the Result of tender for Quota on Garments to be exported to the United States of America; 

  • Referring to Prakas No. 928/MOC/M99 of March 31, 1999 of the Ministry of Commerce on the Cambodia Quotas Definition and Transfer System;

  • Referring to Prakas No. 1345/MOC/M99 of May 14, 1999 of the Ministry of Commerce on the Tender for Quota on Garments to be exported to the United States of America;

  • Referring to Prakas No. 1449/MOC/M99 of May 21, 1999 of the Ministry of Commerce on the Result of tender for Quota on Garments to be exported to the United States of America;

  • Referring to Prakas No. 1565/ MOC/M99 of June 2, 1999 of the Ministry of Commerce on Certain Amendments and Supplements to the Ministry of Commerce’s Prakas No. 928 of March 31, 1999 on the Cambodia Quotas Definition and Transfer System; 

  • Pursuant to the handwritten annotation of Samdech Prime Minister of November 16, 1999; 

  • Seen the needs of the Ministry.  

IT IS  HEREBY DECIDED

Article 1: To accept the surrender of all types of categories of Cambodian textiles and textile products which are subject to quantitative limitations by the Government of the United States of America from the following Cambodian Garment Manufacturers as listed in Annex 1 of this Prakas.  

Article 2: To allocate the above surrendered quotas to other Cambodian garment manufacturers as listed in Annex 2, based on the three following criteria:  

the company has available purchaseing orders from American buyers; 
the company already has already in its warehouse some unsold textile products; and 
the company has enough manpower and machinery to produce and export the said quantity before December 31, 1999.

Article 3: Based on the limited time frame to utilize the above surrendered quotas, the Export Quota Management Committee will not charge any fee other than the regular Export Quota Management Fee (EQMF) and the Administrative Fee for the issuance of Commercial Invoices/Export Visas.  

Article 4: All companies that are allocated surrendered quotas have the an obligation to fully utilize them before December 31, 1999. Unused allocated quotas exceeding 5% of the amount allocated would be charged three (03) times the value of the Export Quota Management Fee (EQMF) for each specific category and three (03) times the amount of the Riels 120,000 administrative fee for the issuance of Export Visas.  


Article 5: The Director of Cabinet, the Technical Director General, the Director of CAMCONTROL Department, the Director of the General System of Preferences Department, and all garment manufacturers shall implement the present Prakas.
