Amending and
Supplementing the Issuance of
Certificates of Origin,
Commercial Invoices, and
Export Licenses for
Exported Garments

the Kingdom of Cambodia on Trade Relations and Intellectual Property Rights
Protection of October 4, 1996;

Referring to the Agreement Relating to Trade in Cotton, Wool,
Man-made Fiber, Non-Cotton Vegetable Fiber and Silk Blend Textile and
Textile Products Between the Royal Government of Cambodia and the Government
of the United States of America of January 20, 1999;

Referring to the letter of the Council of
Ministers authorizing the establishment of the Garment
Factory Technical Inspection Committee No 100/SCN of February 3, 1997;
-
Referring to the Resolutions of the meeting
of the Council of Ministers of September 21, 1997;
-
Referring to Prakas of the Ministry of
Commerce No. 141/MOC/SCDN of April 29, 1997
on the Establishment of the Garment Factory Technical Inspection
Committee;
-
Referring
to Prakas of the Ministry of Commerce No. 340/MOC/PRK of November 28, 1997
on the Establishment of the General Trade Preferences Department;
-
Referring to Prakas No 338/MOC/PRK of
November 28, 1997 on the Organization and Functioning of the Foreign Trade
Department;
-
Referring to
the Textile Agreement which is acknowledged on February 3,
1999;
-
Pursuant to the need to issue Certificates of Origin, Commercial
Invoices and Export Licences in an effective manner.
IT IS HEREBY DECIDED
Article 1: The
supplement to to Prakas No. 1437/MOC of May 25, 1999,
regarding the issuance of certificates
of origin, commercial invoices, and export licenses
for garments shall
include:
The
issuance of a certificate
of origin, commercial invoice, and license for export by air shall have the
following documents:
-
Application
for goods export of the interested company;
-
Receipt
issued by the Department
of Administration;
-
Certificate
of Processing issued by the Ministry of Industry, Mines and Energy;
-
Inspection
Report of an official
of the General System Preferences Department;
-
Invoice of
the company;
-
Packing list
of the company; and
-
Sales
contract between the purchaser and interested company.
Article 2:
The
paragraph “By Air” of Article 1 of Prakas No. 3195/MOC of October 13,
1999, regarding
the issuance of certificates
of origin, commercial invoices, and export licenses
for garments shall
be modified and
replaced as follows:
The issuance of licenses
for the export of
textile products:
The
exportation to the European
Union of categories 4, 5, 6, 7, 8, 15, 21, 28, and 73 shall comply with the
following requirements:
Article 3: At
the end of each month, the Director
of the of
Generalized System of Preference Department, the d
Director
of the Foreign
Trade Department,
and the Director
of Camcontrol
shall collect documents related to
export for joint verification within their own responsibilities and
inspection, do research any factory that applied for a
certificate of origin, commercial invoice, and export license which
failed to export
such goods and to declare for cancellation of such export documents and
report to the Minister for instructions.
Article 4: Any
documents which are contrary to the provisions of this Prakas shall be
abrogated.
Article 5: The
Technical Director General,
the Director General
of Administration
and Finance,
the Director
of generalized system
of preference
Department, the Director
of Foreign trade department,
and the director
of Camcontrol
of the Ministry of Commerce shall perform their respective roles to
effectively enforce this Prakas.
Article 6: This
Prakas shall enter into force from the date of its signature.
