ANUKRET
on the Maintenance of Social Order in Phnom Penh, in the Provinces and Municipalities

 

Royal Government of Cambodia

  • Seen the Constitution of the Kingdom of Cambodia;

  • Seen the Royal Decree of His Majesty the Kingdom of Cambodia, Samdech Preach NORODOM SIHANOUK VARMAN, dated  November1, 1993 on the       Formation of the Royal Government; and

  • Pursuant to the request of the Co-Ministers of Interior

 

IT IS HEREBY DECIDED

 

Article 1:

That maintaining social order, public security, sanitation and hygiene shall be the responsibilities of Cambodian citizen in the Kingdom of Cambodia. Every individual shall strictly obey provincial or municipal orders to maintain social order, public security, sanitation and hygiene in the Kingdom of Cambodia.

 

Article 2:

Offenses committed against social order, public order, sanitation and hygiene as specified in this Sub-Decree are considered as petty offenses.

Petty offenses committed against orders of the governing authority in the Kingdom of Cambodia shall be punished as follows:

·         Warning

·         Cash Fines

·         Compensation of damaged properties

 

Article 3:

Procedures for warnings, cash fines from 2,000 to 50,000 Riel, and compensation of damaged properties resulting from offenses specified in Articles 4 to 16 of this Sub-Decree  shall be determined by the provincial or municipal authorities with the approval by the Co-Ministers of Interior. Forty percent of the fines collected shall be awarded to the collecting  competent institutions, with the balance deposited to the National Treasury.

 

Article 4:

Individuals throwing rubbish out of trash cans put up by the governing authority shall be fined 2,000 Riel. The fines shall be double, triple or quadruple for repeated offenses.

 

Article 5:

Individuals throwing death animals  in public areas shall be fined 5,000 Riel. The fines shall be 10,000 Riel for repeated offenses.

 

Article 6:

Individuals throwing  contruction waste, dead animals in wells and sewage system shall be fined 10,000 Riel. The fines shall be 20,000 Riel for repeated offenses.

 

Article 7:

Individuals shall be fined 50,000 Riel for not clearing the public areas used for their personal activities.

 

Article 8:

All the buildings, hotels, estates, institutions or ministries shall have trash cans. In the event their trash cause hygiene problems to the neighborhood, the owners of such properties shall be warned at first. In the event of refusal to correct the problems, they shall be fined 20,000 Riel.

 

Article 9:

Individual building toilets lacking good sanitation and leading to hygiene problems shall be warned at first. In the event of refusal to correct the problems, they shall be fined 20,000 Riel.

 

Article 10:

Individuals drying clothes in front of their houses affecting the beauty of the cities or provinces shall be warned at first. In the event of refusal to correct the problems, they shall be fined 10,000 Riel.

 

Article 11:

Individuals freeing animals in town or public areas shall be warned at first and their animals captured. In the event of repeated offense, they shall be fined 3,000 Riel per animal.

 

Article 12:

Individuals disorderly displaying goods in public areas shall be warned at first. In the event of repeated offense, they shall be fined 10,000 Riel.

 

Article 13:

Individuals selling things in the banned public places shall be warned at first. In the event of repeated offenses, they shall be fined 2,000 Riel.

 

Article 14:

Individual building houses without permission shall be summoned to enter into an agreement to remove the premises on their own. In the event of refusal, the premises shall be removed  by force and a fine of 50,000Riel shall be imposed.

 

Article 15:

Individual digging public streets without permission shall be fined 50,000 Riel and  compensated for street damages.

 

Article 16:

Individual making loud noise or quarrels effecting social order shall be fined 5,000 Riel. The fines shall be double for repeated offenses.

 

Article 17:

Any regulations contrary to this Sub-Decree shall be annulled.

 

Article 18:

The Co-ministers in charge of the Cabinet of Ministers, the Co-ministers of Interior, the Minister of Economy and Finances, ministers and provincial and municipal governors shall implement this Sub-Decree from the date of its signature.
