on Conferring the Right to Sell and Export Rubber Products
to the Ministry of Agriculture, Forestry, and Fisheries

Royal Decree of His Majesty the Kingdom of Cambodia, Samdech Preach NORODOM
SIHANOUK VARMAN, dated November1,
1993 on the Formation
of the Royal Government;
·
Seen the
Decree No 12, dated February 10, 1990, on the Change of Functions of the
Department General of Rubber Plantations;
·
Seen the
Sub-Decree No 28 dated November 13, 1990, on the Organization and
Functioning of the Department General of Rubber Plantations;
·
Seen the
Sub-Decree No 05, dated August 19,1993, on placing the Department General of
Rubber Plantations under the Supervision of the Ministry of Agriculture,
Forestry, and Fisheries; and
·
Pursuant to
the spirit of the April 29, 1994 Conference in Kompong Cham Province under
the Presidency of the Co-Prime
Ministers.
IT
IS HEREBY DECIDED
Article
1:
To confer the right to sell and export rubber products, with
the exception of solidified rubber in which case the approval must be
authorized by the Royal Government, to the Ministry of Agriculture,
Forestry, and Fisheries (Department General of Rubber Plantations). The
objective is to benefit the domestic industry production and to import
equipment and spare parts and other means to service existing production and
new rubber tree plantings.
Article
2:
After payment of the required taxes to the State, the
Ministry of Agriculture, Forestry, and Fisheries (Department General of
Rubber Plantations) shall be responsible for the collection of the proceeds
from the sale of rubber in order to meet expenses incurred in the rubber
production process including salaries, purchase and import of equipment,
spare parts, and other necessities. The Ministry of Agriculture,
Forestry, and Fisheries shall submit for approval of the Royal Government
request for investment fund for new rubber plantations and construction of
infrastructure, provided the proceeds for the above sale are not adequate.
In the event of force majeure whereby
loss was incurred, the Ministry of Agriculture, Forestry, and Fisheries
shall submit detailed reports to the Royal government requesting its
financial intervention to restore its productivity.
Article
3:
The Ministry of Agriculture, Forestry, and Fisheries
(Department General of Rubber Plantations)
shall have the right to use 30% of the proceeds of the sale to import
items necessary for production, the balance of the foreign exchange shall be
sold to the State according to existing procedures.
Article
4:
Any provisions contrary to this Sub-Decree
shall be annulled.
Article
5:
The Co-ministers in charge of the Cabinet of the Council of
Ministers, the Minister of Agriculture,
Forestry and Fisheries, the Minister of Economy and Finances, and the
Minister of Commerce shall implement this Sub-Decree within their respective
capacity from the date of its signature.
