 ANUKRET
on the Issuance of Passports of the Royal Kingdom of Cambodia

 

Royal Government of Cambodia

·         Seen the Constitution of the Kingdom of Cambodia, particularly Article 126;

·         Seen the Royal Decree of His Majesty the Kingdom of Cambodia, Samdech Preach NORODOM SIHANOUK VARMAN, dated  November1, 1993 on the Formation of the Royal Government;

·         Seen the Law on the Organization and Functioning of the Council of Ministers and its promulgation by Royal Decree (Kram), dated July 20, 1994;

·         Pursuant to the spirit of the Ministerial  Meeting dated  September 21,1994; and

·         On the proposal of the Ministry of Foreign Affairs and International  Cooperation and the Ministry of Interior.

 

IT IS HEREBY DECIDED

CHAPTER I: GENERAL DISPOSITIONS

Article 1:

4 types of passports shall be issued:

a).     Diplomatic passport

b).     Official passport

c).     Regular passport

d).     Travel document

The specifics of these passports shall be specified by a joint declaration of the Ministry of Foreign Affair and International Cooperation and the Ministry of Interior.

CHAPTER II: DIPLOMATIC PASSPORT

Article 2:

Diplomatic passports shall be issued to officials with the following ranks:

1.   The King, The Queen, princes and princesses

2.   Members of the National Assembly

3.   Monks and officials appointed by Royal Decree

4.   The Secretary General of the Cabinet of the King

5.   The Secretary General of the National Assembly

6.   The advisors to the King, the Chairman,  Vice- Chairman of the National Assembly, Prime Minister, Deputy Prime Minister, Senior Ministers, and Ministers

7.   Chief of Cabinet of the Chairman of the National Assembly, Prime Minister, Deputy Prime Minister, Senior Ministers, and Ministers

8.   Former Chairmen of the National Assembly, former Prime Ministers and former Ministers of Foreign Affairs.

9.   Officials in the diplomatic corps.

10.  Diplomatic passports can be given by the diplomat's children whose ages are under 18 and still single.

Article 3:

Diplomatic passports shall be issued by the Ministry of Foreign Affairs and International cooperation.

Article 4:

The validity of the diplomatic passport is 3 years for the first term and can be renewed for another 2 years  period. New passports shall be applied after the 7th year from the date of the first issuance of the passport.

 

CHAPTER III: OFFICIAL PASSPORT

Article 5:

Official passports shall be issued to officials  travel on mission abroad.

Article 6:

Official passports shall be issued by the Ministry of Foreign Affairs and International Cooperation.

Article 7:

The validity and  expiry of official passports and diplomatic passports shall be the same.

 

CHAPTER IV: REGULAR PASSPORT

Article 8:

Cambodian citizenship of both sexes whose ages are over 18 can be issued regular passports for their travel abroad.

Children whose ages are less than 18 can request to have their own passports issued provided they submit written authorizations from their parents or their guardians, family identification cards, and their birth certificates.

Article 9:

Regular passports shall be issued by the Ministry of Interior unless otherwise specified in Article16.

Article 10:

The validity and  expiry of regular passports and diplomatic passports shall be the same.

Article 11:

Passport fees shall be set by a joint declaration of the Minister of Interior and the Ministry of Economy and Finances.

 

CHAPTER V: TRAVEL DOCUMENT

Article 12:

Travel documents can be issued for immigrants of non khmer citizenship as mentioned in Chapter 4 of the Law on Immigration

Article 13:

Travel documents are issued by the Ministry of Interior.

Article 14:

The validity of travel documents shall be determined by the Ministry of Interior but in no event can it exceed 3 years.

Travel documents can be repossessed by the Ministry of Interior if it is deem necessary.

Article 15:

Passport fees shall be set by a joint declaration of the Minister of Interior and the Ministry of Economy and Finances.

CHAPTER VI: RESPONSIBILITIES OF EMBASSIES, COUNSULAR OFFICES  AND THE DEPARTMENT OF PASSPORT

Article 16:

Official and regular passports shall be issued by embassies, counsular offices and the department of passport after the approval from the Ministry of Foreign Affairs and International Cooperation.

 

CHAPTER 7: FINAL PROVISIONS

Article 17:

The Ministry of Foreign Affairs and International Cooperation and the Ministry of Interior shall have the prerogative to void the missing or false passports.

Article 18:

Any other regulations conflicting this Sub-Decree shall be annulled.

Article 19:

The Co-ministers in charge of the Cabinet of the Council of Minister, the Minister of Foreign Affairs and International Cooperation, the Minister of Interior, Ministers of all Ministries, Secretaries of State of all State Secretariats are responsible for implementing this  Sub-Decree from the date of its signature.
