  • Referring to Sechdey Samrech of the Constitutional Council No. 13/CC/SSR of August 25, 1999;

  • Pursuant to a proposal of the Acting President of the National Assembly of August 12, 1999.

HEREBY ORDER
 

Article 1:    The official promulgation of the Law regarding "the Duration of Provisional Detention".  

Article 2:    This Kram shall enter into force from the date of signature herein.

Law regarding “the Duration of Provisional Detention”

 

Article 1:    The duration of provisional detention in any case  whatsoever, shall not exceed four (4) months. If pursuant to, an appropriately justified court decision, such duration may extend to six (6) months time if it is necessary to make an investigation.  

For genocidal crimes, war crimes, and crimes against humanity as stated in various Conventions of the United Nations in which Cambodia is a signatory, this provisional detention period may be extended one year at a time, but the duration of such extension shall not exceed three (3) years. 

Article 2:    Any provision that is in conflict with the provisions of this law, shall be void.  

Article 3:    This law shall be declared as urgent.  

This law is adopted by the National Assembly of the Kingdom of Cambodia on August 12, 1999 at the extraordinary session of the 2nd Legislature.
