Industrial Products Registration
The Minister of Industry, Mines and Energy
-
Referring to the 1993 Constitution of the Kingdom of Cambodia; -
Referring to Reach Kret NS/RKT/1198/72 of November 30, 1998,
on the Formation of the Royal Government of Cambodia; -
Referring to Reach Kram No. NS/KRM/0196/05 of January 24, 1996,
on the Establishment of the Ministry of Industry, Mines and Energy; - Referring to Anukret No. 35/ANK/BK of April
26, 1996, on the Organization and Functioning of the Ministry of Industry,
Mines and Energy; -
Referring to Anukret No. 04/ANK/BK of February 26, 1992,
on the regulation of quality control for industrial and handicraft
products; -
Pursuant to the actual and current situations. IT
IS HEREBY DECIDED Article 1: In
order to ensure proper industrial product labeling in accordance with
national standards and to prevent product counterfeiting, all companies,
factories, enterprises, and handicrafts shall register their products with
the Ministry of Industry, Mines and Energy before circulating such
products on the markets in the Kingdom of Cambodia. Article 2: The
application for registration of industrial products shall comply with the
following formalities: 1.
To complete and file an application form
one copy 2.
To provide a sample of the draft label to be placed on the product package
ten copies 3.
To provide a registration certificate of marks or trademarks (photocopied)
one copy 4.
To list names and standards of material resources used in the
production
one copy 5.
To provide a brief design of the production system
one copy 6.
To provide a number of sample products for laboratory examination and
filing (as needed) 7.
To file a guaranty for the standard of products
one copy 8.
To pay administrative and laboratory examination fees. Article 3: The
official certificate of registration shall be issued after the registrar
finds that the files and product quality stipulated in Article 2 are
accurate and in compliance with such requirements. Article 4: The
product owner shall apply for re-registration after any change to the
standards of his/her industrial product. Article 5: All
advertisements of industrial products, by any means whatsoever, may be
authorized only if such industrial products were registered with the
Ministry of Industry, Mines and Energy. Article 6: Any
person who commits any fraud in the registration of industrial products
for illegal purposes shall be punished under the law. Article 7: Any
Prakas or decision that is contrary to this Prakas shall be abrogated. Article 8: This
Prakas shall enter into force from January 31, 2000 onward. Phnom
