On
the Organization and Functioning of Department of Small Industry/Handicrafts The
Minister of Industry, Mines and Energy
- Referring to the 1993 Constitution of the Kingdom of Cambodia; -
Referring to Reach Kret NS/RKT/1198/72 of November 30, 1998, on the
Formation of the Royal Government of Cambodia; -
Referring to Reach Kram No. NS/KRM/0196/05 of January 24, 1996, on
the Establishment of the Ministry of Industry, Mines and Energy; - Referring to Anukret No. 35/ANK/BK of
April 26, 1996, on the Organization and Functioning of the Ministry of
Industry, Mines and Energy; - Pursuant to the current needs of the Ministry. IT
IS HEREBY DECIDED
Article 1: A Department of Small Industry/Handicrafts is an operational entity under direct supervision of the General Department of Industry, Mines and Energy and shall be responsible for the management, control, and development of small industry/handicrafts within the Kingdom of Cambodia and shall have the following roles and duties: -
To develop short, medium, and long-term plans and master plans
complying with government policies and implement a development program for
small industry/ handicrafts; - To encourage, instruct, and support small industry/handicrafts, and enforce small industry/handicrafts related laws and policies; - To draft laws, regulations, and regulatory documents, including financial and tax matters that are related to small industry/handicrafts; - To develop and implement policies for cooperation with countries, institutions, national, and international organizations and promote the development of small industry/handicrafts; - To review/assess and approve private investment projects or cooperate with relevant institutions; - To organize, create, and coordinate public investment projects and follow up their implementation; - To prepare Prakas authorizing the functioning of small industry/handicrafts; - To evaluate the specifications and quantity of raw resources used by small industry/handicrafts based on technical standards and follow up their utilization; - To prepare a list of products of small industry/handicrafts; - To issue certificates related to small industry/handicrafts' production; - To collect data and analyze small industry/handicrafts' results which are divided into ten (10) categories as follows: 1. Food, drinks, and tobacco; 2. Textiles, garments, and leather products; 3. Wood products, sub-forest products; 4. Paper products; 5. Chemical products, rubber and plastic products; 6. Mineral products, non-metal products; 7. Metallic products industry; 8. Metal processing industry; 9. Other industries; and 10. Traditional handicrafts. -
To study laws, policies, and national and international regulatory
acts on the management, and development of small industry/handicrafts; - To prepare draft laws, and management policies and -encourage small industry/handicrafts; - To organize, manage, promote, and develop small industry/handicrafts; - To prepare directives, regulatory acts, and instructions related to small industry/handicrafts; - To organize training on the management and development of small industry/handicrafts for industry/handicrafts owners at the provincial/municipal level; - To manage and control production activities and provisions of service of small industry/handicrafts ; - To encourage subordinate offices to properly perform their respective roles and duties; and - To follow up and monitor all activities and performance of each office and suggest means for resolving problems. Article 2: The Department of Small Industry/Handicrafts shall be headed by one director and assisted by a number of deputy directors when necessary. Article 3: The Department of Small Industry/Handicrafts shall have the following structure: 1. Administrative Office; 2. Development Office; 3. Small industry Office; and 4. Handicrafts Office. Article 4: The main role and duties of each office are: 1. Administrative
Office Roles: - The Administrative Office is an operational unit assisting the department leadership in matters related to small industrial/handicrafts statistics and administration. Functions: - To propose annual administrative expenditures for department; - To organize and file documents of department (laws, sub-decrees, policies, and regulatory acts related to the department affairs); - To manage the movable and immovable property of the department; - To observe, and collect overall data and evaluate the achievements of the department; and - To prepare monthly, quarterly, semester, first-9-month, and annual completion reports of the department and submit to the ministry. 2. Development Office Roles: - The Development Office is an operational unit assisting the department leadership in matters related to industrial/handicrafts development and the promotion of close cooperation with national and international organizations and other countries around the world for the purpose developing small industry/handicrafts. Functions: - To design management policies for small industry/handicrafts; - To develop long , medium, and short term plans consistent with government policies and ministerial goals for the development of small industry/handicrafts; - To propose public investment projects related to the development of small industry/handicrafts and follow up project implementation; - To propose policies to encourage, instruct, and support small industry/handicrafts; - To draft laws, regulations, and regulatory documents, including financial and tax matters that related to small industry/handicrafts; - To discuss and consult with small industry/handicrafts on methods to strengthen the production management; - To propose training plans and organize training and provide consultation to manufacturers and craftsmen based on production and the provision of services in all province/ municipalities; and - To develop and implement projects and cooperate with countries and international organizations for the purpose of developing small industry/handicrafts. 3. Small Industry Office Roles: - The Small Industry Office is an operational unit assisting the department leadership in preparing, and drafting Prakas and legal instruments certifying the place of production or provision of service, evaluating investment projects and strengthening the production management of provincial/municipal small industry. Functions: - To encourage small industry owners to implement regulations of the ministry and of the government; - To prepare Prakas authorizing the establishment of small industry; - To review and evaluate private investment projects for small industry; - To issue certificates of production for small industry; - To organize production lists of small industry; - To resolve problems relevant to small industry in cooperation with relevant departments and the industry, mine, and energy provincial/municipal offices; and - To propose plans to strengthen the management of small industries in the provinces. 4. Handicrafts Office Roles: - The Small Handicrafts Office is an operational unit assisting the department leadership in preparing, and drafting Prakas and legal instruments certifying the place of production or provision of service; evaluating investment projects and strengthening the management of handicraft production; and conducting research, preparation, and publication of documents related to handicrafts products. Functions: - To encourage small craftmen to implement regulations of the ministry and of the government; - To prepare Prakas authorizing the establishment of handicrafts shops; - To review and evaluate private investment project for handicrafts; - To issue certificates of production of handicrafts; - To organize production lists of handicrafts; - To resolve problems relevant to handicrafts in cooperation with the relevant department and industry, mine, and energy provincial/municipal offices; and - To strengthen management, technical instructions, and provide consultations for handicrafts owner to upgrade the management quality and efficiency, and promote national culture; - To research and compile documents, information, and statistics on traditional handicrafts; and - To advertise traditional handicrafts products. Article 5: Any provisions and decisions that are contrary to this Prakas shall be null and void. Article 6: The Director General of the General Directorate of Industry, Mines and Energy, the General Inspector, the Director of Cabinet, the Director of Personnel, and the Director of Small Industry/Handicrafts shall implement this Prakas under their respective roles.
