on
the Conduct of Legal Improvement Training Course
for High-Level Internship Officials

  • Referring to the 1993 Constitution of the Kingdom of Cambodia;

  • Referring to Reach Kret No. NS/RKT/1198/72 of November 30, 1998 on the formation of the Royal Government of Cambodia;

  • Referring to Reach Kram No. 02/NS/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

  • Referring to Reach Kram No. NS/RKM/0196/09, of January 24, 1996, promulgating the Law on the Establishment of the Office of the Council of Ministers;

  • Referring to Reach Kret No. 06/NS/94, of October 26, 1994, promulgating the Law on Co-Statute of the Civil Servants of the Kingdom of Cambodia;,

  • Referring to Prakas No. 01/BK of the Council of Ministers, of January 4, 1999, regarding the allocation of functions and duties the leadership of the Council of Ministers.


IT IS HEREBY DECIDED
 

Article 1:       A legal training session shall be established in order to improve the knowledge and skills in the legal field for high ranking officials graduated with Bachelors of Law, Economics, or Commerce and serving as interns or working at the Office of the Council of Ministers. 

Article 2:       The training shall be conducted under the supervision of the Legal Reform Unit of the Office of the Council of Ministers. 

Article 3:       The training shall be for nine (9) months or more according to the program and shall cover specific topics to be determined by the Director of the Legal Reform Unit of the Office of the Council of Ministers. 

Article 4:       This program may be concluded or continued for a longer period of time as deemed necessary. 

Article 5:       The topics to be selected for the training shall include:

  1. Public and Administrative Laws;

  2. Cambodian Laws and Regulations;

  3. ASEAN;

  4. Commercial Law and International Economic Institutions; and

  5. Contract Law.

The course details of the above topics shall be listed in the annex of this Prakas. 

Article 6:       High ranking officials who participate in this training session shall be nominated by the Director of the Legal Reform Unit of the Office of the Council of Ministers. 

Article 7:       High ranking officials who regularly participates in the training course shall receive a Certificate of Completion at the conclusion of the training. 

Article 8:       The Head of Administration and Personnel Department, the International Relations Department, the Assessment Services Department, the Secretariat of the Council of Jurists, the National Committee for UNESCO, the Council for Administrative Reform, the Secretariat of the Royal Government Attorney, the Department of ASEAN, the Royal School of Administration, the Industrial Department, the Internal Department, the Protocol Department, the National Authority of Petroleum, the Human Rights Department and Non-governmental Organizations, the Department of Complaints, the Cabinet of the office of Deputy Prime Minister Tol Lah as well as interested bodies shall be in charge of implementing this Prakas. 

Article 9:       Any regulations which are contrary to the provisions of this Prakas shall be null and void. 

Article 10:     This Prakas shall be effective from the date of its signature.
