PRAKAS

on the Organization and Functioning of the Committee in charge of Reviewing the Promotion of Commissioned and Non Commissioned Career Officers. 

The Co-Ministers of Defense

  • Referring to the 1993 Constitution of the Kingdom of Cambodia;

  • Referring to Reach Kret NS/RKT/1198/72 of November 30, 1998, on the formation of the Royal Government of Cambodia;

  • Referring to Reach Kram 02/NS/94 of July 20, 1994, promulgating the Law on the Organization and Functioning of the Council of Ministers;

  • Referring to Reach Kram NS/RKM/0196/07 of 24 January, 1997, promulgating the Law on the Establishment of the Ministry of Defense;

  • Referring to Reach Kram CS/RKM/197/05 of November 6, 1997, promulgating the Law on the General Military Statutes of the Royal Cambodian Armed Forces.

T IS HEREBY DECLARED

 

 Article 1: The promotion for commissioned and non commissioned career officers for the three branches of the Cambodian Royal Armed Forces in compliance with chapter 4, articles 3 )0, 31, 32, and 3 )6 of the General Statutes of the Cambodian Royal Armed Forces shall be done under normal and special circumstances.  

(a) For Commissioned Officer:

  • Normal situations: based on seniority, proportion to the units, and service period.

  • Special circumstances: based on warring periods for those who have combat accomplishments, those who were killed in battle or during peace for those who voluntarily resign from the armed forces or request for retirement pursuant to the Ministry of Defense policy.  

(b) For Non Commissioned Officer:

  • Normal circumstances: based on seniority, proportion to the units, types and number of armed forces required, chosen among non commissioned career officers who have sufficient seniority, degree or certificate of military education, and annual individual merits.

  • Special circumstances: based on those who were killed in battle or during peace for those who voluntarily resign from the armed forces or request retirement pursuant to the Ministry of Defense policy.  

The promotion of  commissioned and non commissioned career officers under the normal circumstances shall be made review by the ranking committee.

 

Article 2:    The composition of the Promotion Committee of the three armed forces branches shall include:

  • The Minister of Defense                                                                        Chairman

  • The Commander-in-Chief of the Royal Armed Forces                               Deputy Chairman
    One commander representing the Army, Navy, Air Force,.

  • Gendarmerie, and specialized units                                                       Member

  • The Director of the Personnel Department of the Ministry of Defense        Reporter

  • The Director of the Personnel Office of RCAF's Chief of Joint Staff            Secretary

 

Article 3:    The Promotion Committee shall convene an annual meeting of its members .  

The Department of Personnel shall instruct, manage,. and compile files requesting the promotion of commissioned and non commissioned career officers of the three armed forces branches from various military units and institutions under the Cambodian Royal Armed Forces, including:

  1. The promotion application of commissioned and non commissioned career officers by unit and category of armed forces.

  2. The table of seniority records of the commissioned and non commissioned career officers as of the year of promotion which is annually prepared by each unit, based on type of weapon, skills, and type of armed force.  

These files shall be sent to the Department of Personnel in early of September of each year for inclusion and report to the Promotion Committee for review and approval. 

Article 4:   The Cabinet of the Ministry of Defense, Cabinet of the Chief of Joint Staff, and all units under the Cambodian Royal Armed Forces shall be responsible for the enforcement of this Prakas form the date of its signature.
