  • Referring to the 1993 Constitution of the Kingdom of Cambodia;

  • Referring to Kram 02/NS/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

  • Referring to Reach Kret NS/RKT/1198/72 of November 30, 1998 on the formation of the Royal Government of Cambodia;

  • Referring to Reach Kret No. 0399/72 of  March 19, 1999 on the Appointive of the Supreme Council of State Reform;

  • Referring to Anukret No. 51/ANK/BK of June 10, 1999 on the Establishment of the Administrative Reform Council;

  • Pursuant to the Proposal of the Chairman of the Administrative Reform Council.


IT IS HEREBY DECIDED
 

CHAPTER 1

General Provisions
 

Article 1:    This Anu-kret shall define the functions, duties and organization of various units of the Secretariat General of the Administrative Reform Council. 

CHAPTER 2

Roles, Duties and Structures 

Article 2:    The Administrative Reform Council shall have a Secretariat General as an executive entity to be directed and managed by a General Secretary. 

Article 3:    The Secretariat General shall have the mission to implement the administrative reform programs as advised and directed by the Chairman of the Administrative Reform Council. In this mission, the Secretariat General shall have the responsibilities of studying and presenting proposals for short, medium and long‑term administrative reform projects to the Royal Government through the Administrative Reform Council; to monitor and evaluate the implemented reform projects; and produce regular reports on the scope of the project implementation to the Royal Government. 

In this role, the Secretary General shall fulfill his functions to conceptualize, plan actions, implement, coordinate and evaluate every horizontal line project, including:

  • Organization and functions of state institutions

  • Rules and regulations of the public functions

  • Financial and administrative management of the civil service

  • Human resources development for the public administration

  • Materials and leadership undertaking

  • Modernization of equipment.

Sect oral reform projects are under the direct responsibilities of the concerned ministries. The Secretary General shall have the duties to oversee and ensure smooth coordination of the sect oral reforms and horizontal line reform projects. 

Article 4:    The Secretariat General shall convene meetings twice a month as requested and instructed by the Secretary General. 

Article 5:    The Secretariat General shall be entitled to use the seal of the Office of the Council of Ministers to carry out its assignments. 

Article 6:    The Secretary General shall be entitled to present proposals for the appointment or dismissal of staff of the Secretariat General to the Chairman for consideration and decision. 

Article 7:    The Secretariat General shall have the following structure:

  1. Sect oral Project Team

  2. Horizontal Line Project Team

  3. Information and Human Resources Team

  4. General Administration and Supply Team

Article 8:    The detailed assignment of duties of staff and officials working in the Secret Nat General shall be defined by a prakas of the Administrative Reform Council. 

Article 9:    The Sect oral Project Team shall have the following main functions and duties:

  • Provide advice and technical assistance to concerned ministries and institutions;

  • Responsible for the technical interface and relations between the Secretariat General and other ministries or institutions;

  • Report to the Secretariat General and follow up the progress of reform projects at ministries or institutions.

Article 10:  The Sect oral Project Team shall be a dialogue partner with representatives from the ministries or institutions on matters related to the administrative reform: 

Each ministry or institution shall have the obligation to set up its own Administrative Reform Working Group to:

  • Liaise with the Secretariat General.

  • Ensure the efficiency of reform projects at concerned ministries or institutions.

  • Participate in the development of administrative reform projects of concerned ministries or institutions.

  • Act as an interface with other projects of concerned ministries or institutions.

The Sect oral Project Team shall be directed and managed by a project director and assisted by deputy project director's as required. 

Article 11:  The Horizontal Line Project Team shall have the following main functions and duties:

  • Assist  the Secretariat General in selecting and providing technical validation for all projects;

  • Initiate and design administrative reform projects in the Horizontal Line Project Team;

  • Implement, follow up and evaluate projects in the Horizontal Line Project Team.

The Horizontal Line Project Team shall be directed and managed by a project director and assisted by deputy project director's as required. 

Article 12:  The Information and Human Resources Team shall have the following main functions and duties:

  • Undertake possible implementation of changes within the institution by identifying and mobilizing potential local human resources;

  • Develop ongoing human resources, and integrate them into the national experts group in the fields of law, finance, administration, management, information technology and accounting, etc.

  • Responsible for the publication of information bulletins and awareness campaign bulletins on administrative reform;

  • Responsible for information services and public relations in the interest of the Secretariat General;

  • Study and propose measures to improve the administrative reform to the Secretary General.

  • Responsible for maintaining internal and external relationships between the Secretariat General and other entities.

The Information and Human Resources Team shall be directed and managed by a project director and assisted by deputy project director's as required. 

Article 13:  The General Administration and Logistics Team shall have the following main functions and duties:

  • Coordinate all administrative activities of the Secretariat General.

  • Manage and circulate the administrative documents of the Secretariat General.

  • Ensure the administrative effectiveness and welfare of the Secretariat General.

  • Consolidate, and report on work performance and activities of the Secretariat General

  • Manage the administration, staff and secretaries of the Secretariat General.

  • Provide the necessary logistical support to the Secretariat General.

  • Develop and implement the annual budget plan of the Secretariat General.

  • Record incomes and expenditures of the Secretariat General.

  • Provide follow‑up and reminder on the implementation of the budget, and the management of account of the Secretariat General.

  • Identify needs and develop a suitable expenditure plan.

  • Manage current assets, fixed assets, stock, and produce inventory lists.

  • Organize and coordinate the meetings and discussions of the Administrative Reform Council.

  • Produce and deliver quarterly expenditure reports.

  • Coordinate and follow up the financial assistance for sect oral administrative reform at each ministry to ensure the synergy of resources.

  • Responsible for the archives, documentation and translation services.

The General Administration and Logistics Team shall be directed and managed by a project director and assisted by deputy project director's as required. 

Article 14:  The Secretariat General shall employ the staff from the civil service or may recruit contractual staff. The conditions for granting benefits for contractual staff and special remuneration for civil servants staff shall be defined by a Prakas of the Chairman as proposed by the Secretary General. 

Article 15:  Members and staff of the Secretariat General may receive the remuneration provided directly by donor countries or international organizations. 

CHAPTER 3

Final Provisions
 

Article 16:  The organization and functions of the Secretariat General from the departmental level downward shall be defined by a Prakas of the Office of the Council of Ministers as proposed by the Secretary General. 

Article 17: Any other provisions contrary to this Anukret shall be considered null and void. 

Article 18:  The Deputy Prime Ministers, the Minister in charge of the Office of the Council of Ministers, Senior Ministers, ministers and state secretaries of relevant ministries/institutions and all members of the General Secretariat of the Administrative Reform Council shall be responsible for the enforcement of this Anukret in accordance with their respective responsibility from the date of its signature.
