on the
Establishment of the Council for Armed Forces Demobilization

Referring
to the 1993 Constitution of the Kingdom of Cambodia;
-
Referring
to Reach Kret NS/RKT/1198/72 of November 30, 1998 on the formation of
the Royal Government of Cambodia;
-
Referring
to Kram 02/NS/94 of July 20, 1994 promulgating the Law on the
Organization and Functioning of the Council of Ministers;
-
Referring
to Reach Kret No. 0399/72 of March
19, 1999 on the Appointment of the Supreme Council of State Reform;
-
Pursuant
to the request of the Chairman of the Supreme Council of State Reform.
IT IS HEREBY DECIDED
CHAPTER 1
THE COUNCIL
FOR ARMED FORCES DEMOBILIZATION
Article
1: The
Council for Armed Forces Demobilization is an administratively autonomous
body. The Council, conforming to the direction and under the
supervision of the Supreme Council of State Reform, has as its mission,
the initiation and promotion of demobilization of the armed forces, and
plays a role as the regulating and prime force with responsibility for the
actual results.
Article
2: In
order to carry out the mission as stated in Article 1, the Council shall
have the following roles and responsibilities:
-
to
initiate and propose strategies and work programs for achieving the
objectives laid down by the Supreme Council of State Reform.
-
to
implement all instructions received from the Supreme Council of State
Reform and operationally the military demobilization strategies and
programs.
-
to
propose to the Supreme Council of State Reform draft texts or
necessary measures to operationally
the military demobilization programs.
-
to
prepare policies and accurate work plans concerning the military
demobilization.
-
to
maintaining liaison with provincial-municipal authorities, local NGOs
and international NGOs, friendly countries and some private sector
entities and to attach special consideration on resources mobilization
from the state and international assistance needed for implementing
the military demobilization.
-
to
make decisions and issue necessary directives within the limit of its
jurisdiction to operationally
the military demobilization programs.
Article
3: The
Council shall be composed of the following:
-
Sr. Minister
and Minister in charge of the Office of the Council of Ministers as
Chairman.
-
Secretary
of State of National Defense as Vice-Chairman.
-
Deputy
Commander-in-Chief of the RCAF as Vice-Chairman.
-
A
Secretary of State of Interior as member
-
A
Secretary of State of Economy and Finance as member.
-
A
Secretary of State of Rural Development as member.
-
A
Secretary of State of Social Affairs, Labor, Vocational Training and
Youth Rehabilitation as member.
-
A
Secretary of State of Women and Veteran Affairs as member.
-
A
Secretary of State of Agriculture, Forestry and Fisheries as member.
-
An
Adviser to Prime Minister Hun Sen in charge of military affairs as
member.
-
A
Secretary of State of Land Management, Urban planning and Construction
as member. Ministers as member. Under Secretary of State at the
Council of Deputy Chief of Joint Staff of the Commander-in-Chief
as member.
Article
4: The
Council Chairman shall be responsible for:
-
fulfilling
efficiently and properly the works of the Council;
-
setting
agendas of the Council's meetings and presiding over the meetings and
making decisions.
-
inviting
members of the government, or prominent persons qualified to
participate in the meetings.
-
signing
bilateral and multilateral funding agreements, or legal instruments
relating to military demobilization in conformity with the laws an
regulations.
-
managing
the Council's administration and finances.
CHAPTER 2
EXECUTIVE
SECRETARIAT
Article
5: The
operations of the Council shall be managed by a Secretary General.
-
The
Secretary General shall be nominated by a Royal Decree.
-
He
can be assisted by a number of deputy secretary-generals with ranks
equivalent to deputy general director, and shall be nominated by a
Royal Decree.
-
He
shall be responsible for leading and administering the Council's
operations through delegates and under the supervision of the Council
Chairman.
CHAPTER 3
RESOURCES
Article
6: The
operational staff may be civil servants or contractual agents. The
conditions for the remuneration of contractual agents and special
allowances for civil servants shall be set by Prakas of the Council,
pursuant to the requests of the Secretary General.
Article
7: The
Council shall have a separate budget account in the Council of Ministers'
budget.
The
resources of the Council shall consist of:
-
funding
from the national
budget.
-
financing
from donor countries or international organizations
-
contributions
of the private sector.
The
Council Chairman is the organizing delegate of the Council’s budget.
CHAPTER 4
Final
Provisions
Article
8: All
regulations contrary to this Anu-kret shall be considered as null and
void.
Article
9: This
Anu-kret shall come into effect from the date of its signature.
Article
10: The
Minister in charge of the Office of the Council of Ministers, the
Minister of Economy and Finance, the Co-Ministers of National Defense, the
Co-Ministers of Interior, the Minister of Rural Development, the Minister
of Social Affairs, Labor, Vocational Training and Youth Rehabilitation and
ministers and state secretaries of relevant ministries/institutions shall
be responsible for the enforcement of this Anukret in accordance with
their respective responsibility.
