on Temporary Leave of Civil Servants During the
Preparatory Period of the Parliamentary Elections

  • Referring to the 1993 Constitution of the Kingdom of Cambodia;

  • Referring to Reach Kret of November 1, 1993 on the formation of the Royal Government of Cambodia;

  • Referring to Reach Kram No. 02/NS/RKM/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

  • Referring to Reach Kret No. NS/RKT/1094/90 of October 31, 1994 on the Reorganization of the Composition of the Royal Government of Cambodia;

  • Referring to Reach Kram No. 06/NS/94 of October 30, 1994 promulgating the Law on the General Statutes of the Civil Service of the Kingdom of Cambodia;

  • Referring to Reach Kret No. CS/RKT/0897/14 7 of August 7, 1997 on the Reorganization of the Composition of the Royal Government of Cambodia;

  • Referring to Kram No. CS/RKM/1197/005 of November 16, 1997 on the General Statute of Military Personnel of the Royal Cambodian Armed Forces.

  • Referring to Reach Kret No. NS/RKT/1297/06 of December 26, 1997 on the Parliamentary Elections

  • Pursuant to the proposal of the Co-Ministers in charge of the Office of the Council of Ministers and consultation with the National Election Committee

  • Pursuant to a resolution of the Council of Ministers at its plenary session on May 29, 1998.


IT IS HEREBY DECIDED

 

Article 1:       A civil servant who has been appointed as chief, deputy chief, or member of the National Election Committee shall apply for a temporary leave from his/her position until there is a new appointment. During this period the seniority of such civil servant shall be calculated for promotion and retirement, but he/she shall not receive a salary. 

Article 2:       A civil servant who has been appointed as chief, deputy chief, or member of the Provincial/City National Election Committee shall apply for a temporary leave from his/her position until such position expires. During this period the seniority of such civil servant shall be calculated for promotion and retirement, but he/she shall not receive a salary. 

Article 3:       A civil servant who has been appointed as chief, deputy chief, or member of the Khum/Sangkat Election Committee shall apply for a special leave from his/her position until the date of the final declaration of the election results. An official of the Khum/Sangkat Election Committee shall apply for a special leave from his/her position until such position expires. During this special period the seniority of such civil servant shall be entitled to salary, seniority for promotion, and retirement funds. 

Article 4:       A civil servant who has been appointed by the National Election Committee and Election Committee of all levels shall apply for a special leave from his/her position until the date of the final declaration of the election results. An official of the Khum/Sangkat Election Committee shall be entitled to leave his/her position to work for such committee and return to serve his/her function until such position expires. 

A copy of permission letters authorized by the ministry, institution, or entity shall be submitted to the Council of Ministers and the National Election Committee. 

Article 5:       One or two officials who continue to serve the Provincial/City Election Committee shall apply for additional leave from his/her position within sixty (60) days after the date of the final declaration of the election results through the next elections. During this period the seniority of such civil servant shall be entitled to salary, seniority for promotion, and retirement funds. 

Article 6:       The minister in charge of the Council of Ministers, ministers, secretaries of state and interested civil servants shall effectively implement this Anukret from the date of signature herein.
