on the Establishment of a Steering Committee
for the Three Areas of Intellectual Properties.

• Referring to the 1993 Constitution of the Kingdom of Cambodia;

• Referring to Reach Kret NS/RKT/1198/72 of November 30, 1998 on the formation of the Royal Government of Cambodia;

• Referring to Kram 02/NS/94 of July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

• Referring to the Agreement on Trade Relations and Intellectual Property Rights Protection between the Kingdom of Cambodia and the United States of America of October 4, 1996;

• Pursuant to the proposal of the Minister of Commerce and the spirit of the inter‑ministerial meeting of  February 10, 1999.

IT IS HEREBY DECIDED

Article 1:    To establish a committee governing three areas of intellectual propertyies whose composition shall be as follows:

• H.E. the Minister of Commerce                                                         Chairman

• H.E. the Minister of Industry, Mines and Energy                                 Vice-chairman

• A representative of the Ministry of Culture and Fine Arts                      Member

• A representative of the Ministry of Information                                     Member

Article 2:    The committee shall have the following responsibilities:

• To speed up the drafting of all laws relating to the implementation of the Agreement on Trade Relations and Intellectual Property Rights Protection between the Royal Government of Cambodia and the United States of America and the Agreements between the Royal Government of Cambodia and ASEAN countries. To smoothly coordinate all affairs related to intellectual property rights between the Ministries of Commerce, Industry, Mines and Energy, Culture and Fine Arts, Information, and other relevant ministries and institutions.

• To coordinate and receive assistance in the field of intellectual property from the international community.

• To report progress to the Royal Government from time to time.

Article 3:    The committee shall have a secretariat to assist  its work. The secretariat shall be composed of:

• The Director of Intellectual Property Department                                 Chairman

• A representative of the Ministry of Industry, Mines and Energy             Member

• A representative of the Ministry of Culture and Fine Arts                      Member

• A representative of the Ministry of Information                                     Member

The secretariat is located at the Intellectual Property Department of the Ministry of Commerce, and if necessary, it can employ a group of assistants. 

Article 4:    The committee members shall attend meetings at the invitation of the chairman. 

The committee shall have the right to use the official seal of the Ministry of Commerce in carrying out its works. 

Article 5:    The Ministers in charge of the Office of the Council of Ministers; Economy and Finance; Foreign Affairs and International Cooperation; Commerce; Industry, Mines and Energy; Culture and Fine Arts; Information; all ministers, secretaries of state of concerned ministries, and institutions and the personalities specified in Articles 1 and 3 shall implement this Prakas from the date of its signature.
