on the Establishment of the Sihanoukville Industrial Zone

• Seen the Constitution of the Kingdom of Cambodia;

• Seen the Royal Decree of His Majesty the King of Cambodia Samdech Preah
  NORODOM SIHANOUK VARMAN dated November 01, 1993 on the
  Appointment of the Royal Government of Cambodia;

• Seen the Royal Decree No. 1094-83 dated October 24, 1994 on the Reorganization of the Composition of the Royal Government of Cambodia;

• Seen the Royal Decree No. 1094-90 dated October 31, 1994 on the Reorganization of the Composition of the Royal Government of Cambodia;

• Seen the law on the Organization and Functioning of the Council of Ministers promulgated by the Royal Decree No. 02/94 dated July 20, 1994;

• Referring to the proposal of the Minister of Industry Mines and Energy.

It is Hereby Decided

Article 1:

To create an industrial zone in Stung Hav district of Preah Sihanoukville, called “Stung Hav Industrial Zone of Preah Sihanoukville”.

Article 2:

Stung Hav Industrial Zone of Preah Sihanoukville is a special industrial development zone to promote production and exploitation activities of general industry, export industry, free trade industry and other services.

Article 3:

Stung Hav Industrial Zone of Preah Sihanoukville shall be devided as follows:

• The general industrial area shall be the center of the industrial activities and other activities involved in production of goods for domestic needs and for export;

• The industry for export area shall be the center of the industrial activities and other activities with a minimum of 80 % of goods produced for export;

• The industry and services area shall be for duty-free support activities such as storage, wrapping, collection, cleaning and products finishing, and otheh activities that are not prohibited by law.

Article 4:

Stung Hav Industrial Zone of Preah Sihanoukville shall have approximately 1,150 ha in the location as showned in the map with the following coordinates:

Article 5:

The Stung Hav Industrial Zone of Preah Sihanoukville as specified in Article 4 shall be considered as state property and be governed by a Board of Directors in which its composition and functioning shall be determined by a Sub-Decree.

Article 6:

To manage and supervise the industrial zone, the Ministry of Industry, Mines and Energies shall have the responsibilities of preparing the proposal for the creation of the Industrial Zone Authority of Cambodia. This authority shall governed by a Board of Directors in which its composition shall comprise of representatives of the relevant ministries and institutions.

The organization and functioning of the Industrial Zone Authority of Cambodia shall be determined by a Sub-Decree.

Article 7:

Any provisions contrary to this Sub-Decree shall be annulled. 

Article 8:

The Co-Ministers in charge of the Office of the Council of Ministers, the Minister of Industry, Energy and Mines, ministers and Secretaries of State of relevant institutions and the Governor of Sihanoukville shall be responsible for implementing this decision within their respective capacity.
